Can anyone offer any advice. We are buying a property that has two problems. Both seem grey areas and any advice welcome. The house was cut out of the next door house quite some time back. The problems are:
1. The staircase of the property hangs over next door (I think it is contained in a seperate stairwell but the neighbouring house at one stage owned this portion of land and as a result the staircase constitutes a flying freehold). Are we best getting an indemnity insurance policy prior to purchase, OR, ensuring that provisions such as right of access and rights of support and mutually enforceable covenants for repair are in place. As I say, I think the stairwell is in its own 'column' and so am not sure next door have any access to it anyway. Its just that its technically built on their land.
2. The house is a terrace and a small forecourt exists between the front of the house and the pavement. All the neighbouring houses have this forcourt enclosed in railings. Ours does not and it seems that no one has registered title to this land. Is it advisable to go ahead and purchase in the hope that we can obtain possessory rights at some point in the future?
